DMCA Notice and Takedown Procedure
GetDapk respects the intellectual property rights of others and adheres to the Digital Millennium Copyright Act (DMCA). We have established a process for copyright holders or their authorized representatives to report alleged infringement of their copyrighted works on our website.
If you believe that your copyrighted content has been posted on GetDapk without authorization, you can submit a DMCA takedown notice as outlined below.
How to Submit a DMCA Takedown Notice
To file a DMCA takedown notice, please provide the following information:
- Identification of the copyrighted work that you claim has been infringed, or a list of such works if multiple works are involved.
- Identification of the material you believe to be infringing, with sufficient detail to locate the material (e.g., URL of the page where the material appears).
- Your contact information, including your full name, physical address, email address, and phone number.
- A statement that you have a good faith belief that the use of the material in question is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Once we receive a valid DMCA notice, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the infringing content.
Counter-Notification
If you are the user who uploaded the content that was removed due to a DMCA takedown notice and you believe that the removal was a mistake or that you have the right to use the content, you may submit a counter-notice. The counter-notice must include:
- Your full name, address, and contact information.
- A description of the content that was removed and the URL(s) where the content appeared before it was removed.
- A statement, under penalty of perjury, that you believe the content was removed due to a mistake or misidentification.
- Your physical or electronic signature.
Upon receiving a valid counter-notice, we will forward it to the original copyright claimant. If we do not receive a notification that legal action has been initiated, we may reinstate the content that was removed.
How We Process DMCA Notices
When we receive a DMCA takedown notice, we will review it and, if valid, promptly remove or disable access to the infringing content. We will notify the individual who posted the content about the takedown request. The user has the right to file a counter-notice if they believe their content was removed in error.
